Jamestown, Pennsylvania. – This morning, PETA and the Animal Welfare Fund filed a lawsuit in the US District Court for the Western District of Pennsylvania against Pymatuning Deer Park, arguing that cruelty to big cats, lemurs and other protected animals at the roadside zoo violates endangered species rules. Law (ESA).
The lawsuit alleges, among other things, that Pymatuning did not provide proper veterinary care to a tiger that was shot without a medical examination. A wounded young lion was trapped in a nearby dark squalid holding area when three shots were fired. He was held there for two months after being attacked by another lion for the first time on several occasions and now suffers from poor coordination and muscle wasting. Pymatuning also keeps emotionally challenging ring-tailed lemurs in a small barren aviary, making it impossible for them to forage, climb, or hide, and traps the highly intelligent macaw in a cramped cage with little to touch or do. The groups claim that ill-treatment in a facility with everything the animals there, including the Bosco bear, are a public nuisance under state law and are asking the court to order the animals to be transferred to reputable institutions.
Since PETA and the Animal Welfare Fund notified Pymatuning of their intention to sue (as required by the ESA) in December, a bear cat and a European Space Agency-protected black and white lemur named Lola were killed in a fire reportedly was caused by an electric heater. Before her death, Lola was in solitary confinement for a long time, although she belonged to a very social species.
“This disgusting business has shot animals, let them die in flames, and caused many others to suffer — and this must stop,” says Brittany Peet, deputy general counsel for the PETA Animal Bondage Foundation. “Plaintiffs are looking forward to being able to appear before a judge at Pymatuning Deer Park and bring the animals to suitable premises where their lives can finally begin.”
“The animals exploited by Pymatuning, including endangered species, are kept in unacceptable and illegal conditions,” said Stephen Wells, executive director of the Animal Legal Defense Fund. “There are state and federal animal welfare laws to ensure that animals are not forced to live without proper veterinary care in barren, dull enclosures. We will strive to enforce these laws to enable them to behave naturally. ”
Pymatuning also kept Bosco, who is showing signs of arthritis, in an antiquated concrete pit for decades; displays vulnerable young animals, including cubs and kangaroos, prematurely separated from their mothers; and allows the public to come into uncontrolled contact with a variety of animals, including parrots, in the budgerigar stall.
PETA, whose motto is in part that “animals are not ours to be used for entertainment” – opposes arrogance, a human superiority-oriented worldview that promotes violence against other animals.
